Govt publishes Responsible Actors Scheme draft regs

<p>The government has published the draft regulations which will establish its Responsible Actors Scheme (RAS) through the Building Safety Act.</p> <p><span>Under the legislation, likely to be implemented by the summer, the Department for Levelling Up, Housing and Communities (DLUHC) has now revealed details of the operation of the RAS which eligible developers must join if they wish to continue to build major developments in England. </span></p><p><span>Companies will be expected to join the scheme if they are residential property developers or have developed relevant buildings between 1992 and 2022, as expressed through the government’s <a href="http://www.house-builder.co.uk/news/housebuilders-sign-govs-building-safety-pledge">building safety pledge</a> and developer remediation contract.</span></p> <p><span>Developers will be expected to sign up to the RAS if they have annual profits exceeding </span>£10 million. This will be determined from the calculation of three-year total profits divided by three over the prescribed timeframe. The stipulation will be based on average profits in the three years of 2017 to 2019.</p> <p>Those who join the scheme must sign the <a href="http://www.house-builder.co.uk/news/govt-publishes-developer-remediation-contract">remediation contract</a> with levelling up secretary Michael Gove.
